E-Commerce & Privacy

www.mantellisdiirectsa.co.za sells goods online. Any product bought from this Website is at the purchaser’s risk. The purchaser/user indemnifies and holds Mantellis Direct Simmonds St harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.

Mantellis Direct Simmonds St undertakes to take all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. Mantellis Direct Simmonds St cannot be held responsible for security breaches occurring on the User’s electronic device, which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

Cancelled Orders

Cancelled orders on the e-commerce facility will be refunded after deduction of a 30% charge on the sales amount for administration costs. The Provider reserves the right to cancel or replace an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards.

Returns / Refund Policy

Should your order be delivered, the onus is on the customer to insure their order against loss or damage. If on receiving your order the item is not what you ordered, please let our customer service team know within 48 hours of receiving the order and we will gladly investigate the matter after which a ruling will be made .Should our investigation conclude that we have not supplied the correct item/s we will replace it at our expense or provide you with a refund provided the item is in its original condition and original packaging.

Payment Options

Payment may be made via Visa, MasterCard, or by EFT bank transfer into the Provider’s bank account, the details of which will be provided after checkout.

Credit card acquiring and security

Credit card transactions will be acquired for the Provider via approved payment gateways. Our payment gateways use the strictest form of encryption, and no credit card details are stored on the website.

Customer details separate from card details

Customer details will be stored by the Provider separately from card details.

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).

Mantellis Direct Simmonds St takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support and dispute resolution

Shipping & Handling

Deliver will be by a courier company chosen by Mantellis Direct Simmonds St. THE GOODS WILL NEED TO BE SIGNED FOR AND CHECKED IMMEDIATELY ON DELIVERY BY YOUR OWN PERSONNEL NO SHORTAGES WILL BE REIMBURSED OR DAMAGES EXCHANGED ONCE THE COURIER SERVICE HAS DELIVERED THE GOODS AND LEFT YOUR PREMISES . THE ONUS IS ON YOU THE CUSTOMER TO CHECK YOUR GOODS AND REPORT A SHORTAGE TO THE DRIVER OF THE COURIER COMPANY AS WELL AS MAKE A WRITTEN NOTE OF THE SHORTAGES ON THE WAYBILL .AT THE SAME TIME IMMEDIATELY NOTIFY US THE SUPPLIER BY WAY OF EMAIL OR PHONE CALL ( DETAILS IN CONTACT'S) . IN ADDITION IF YOU SUSPECT YOUR PARCEL HAS BEEN TAMPERED WITH (BROKEN SECURITY TAPE) DO NOT RECEIVE THE GOODS AND NOTIFT US IMMEDIATELY . MANTELLI'S DIRECT SIMMONDS WILL INSURE YOU PARCEL SHOULD YOU FEEL THE NEED FOR AN ADDITIONAL R89 FOR A CLAIM OF UP TO R1000 CONTACT US BEFORE YOU PLACE YOUR ORDER . DELIVERY WILL TAKE PLACE DURING THE COURSE OF BUSINESS FROM MONDAY TO FRIDAY . ( OUR COURIERS DO NOT DELIVER DURING SPECIFIED TIMES) An additional delivery fee can be charged by Mantellis Direct Simmonds St. Should the following occur:

1. The item was not signed for because the customer was not present at the listed delivery address.

2. The item could not be delivered because the address provided by the customer was incorrect or incomplete.

Shipping costs are disclosed on check out based on the delivery address.

Product Sales

All products displayed on this site are subject to availability. All prices displayed on the site are quoted in South African Rands including VAT but excluding packaging and delivery. Mantellis Direct Simmonds St reserves the right without prior notice to discontinue or change prices or specifications on products and services offered on this site without incurring any obligations.

Pre-Orders

Mantellis Direct Simmonds St requires a deposit or full payment on items on Pre-Order. We cannot guarantee dates of delivery as we are reliant on various suppliers & cannot predict delays in shipping & availability from their factories.

GOVERNING LAW AND JURISDICTION

7.1. This Agreement shall be governed by the laws of the Republic of South Africa. Any claim or dispute between You and the Company that arises in whole or in part from the Site shall be decided exclusively by a court of competent jurisdiction, more specifically the South Gauteng High Court, of South Africa.

SEVERABILITY AND WAIVER

8.1. If any provision of these Terms and Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

8.2. No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and the Company's failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

RETURNS/DEFECTIVE PRODUCT CLAUSE:

9.1 If you wish to return a product for any reason, you may do so within 7 days of receipt of the product. However, please note that a 30% repacking fee will be charged for all returned products provided the product is in it's original packaging. You are responsible for returning the product at your own courier cost and any other associated costs.

9.2 If the product is defective, we will offer a full refund provided that the product is returned to us at your own cost. We will assess the product and determine whether to accept or decline the refund request. If the refund is declined, the30% repacking fee will apply.

ENTIRE AGREEMENT

10.1. These Terms and Conditions, together with the Privacy Policy and any other legal notices published by the Company, shall constitute the entire Agreement between You and the Company concerning the Site.

CONTINUED USE

11.1. If you do not agree to the revised Terms, your only recourse is to discontinue the use of the Site. Your continued use of the Site following any amendment of these Terms and Conditions will signify your assent to and acceptance of its revised terms.

INDEMNITY
